Terms and Conditions
These Terms and Conditions (the "Terms") are an agreement between you and Quédate Tranquila about your use of the Quédate Tranquila mobile app (the "App"). Please read them carefully. By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
The short version
- The App is for adults 18 and older. It offers education and wellness tools, not medical care.
- Be kind to other members. Harassment and misuse can get your account suspended.
- You own what you write in the App. We own the App and its lessons, audio, and images.
- The App is provided "as is," and our liability is limited as described below.
1. Who can use the App
You must be at least 18 years old to use the App. By using it, you confirm that you are 18 or older and that you can legally agree to these Terms. You may have only one account, and the information you give us must be accurate.
2. Your account
Keep your password private. You are responsible for everything that happens under your account. If you think someone else has used your account, tell us right away at QTprogram@isagroup.com.
3. Not medical care
The App offers education, relaxation practices, and wellness tools to help you manage everyday stress. It is not medical or mental health care. It does not diagnose or treat any condition, and it does not replace a doctor, therapist, or other licensed professional. Always talk with a qualified provider about your health, and do not ignore or delay professional advice because of something in the App.
The App is not an emergency service, and no one monitors what you enter. If you are in crisis or thinking about harming yourself, call or text 988 (Suicide & Crisis Lifeline, with support in Spanish) or call 911 in an emergency.
Some practices involve breathing, movement, or relaxation. Stop any practice that makes you uncomfortable, and check with your doctor first if you have a health condition.
4. Community guidelines
Quédate Tranquila is a community of women supporting each other. When you use community features, such as sending flowers of encouragement, you agree to:
- be respectful and kind to other members;
- not harass, bully, threaten, or discriminate against anyone;
- not pretend to be another person; and
- not use the App to spam, advertise, or ask members for money or personal information.
We may remove content or limit access for anyone who breaks these guidelines.
5. Your content
You own what you enter in the App, such as mood entries, reflections, goals, and lesson answers ("Your Content"). You give us a limited permission to store, process, and display Your Content only as needed to run the App for you, as described in the Privacy Policy. This permission ends when you delete your account, except as the Privacy Policy describes. Your private entries are not shown to other members.
6. Our content
The App and everything in it, including the learning modules, audio practices, videos, infographics, images, text, logos, and design, belong to Quédate Tranquila or the people who license it to us. They are protected by copyright and trademark laws. We give you a personal, non-transferable, revocable license to use the App on your own devices for your own non-commercial use. We keep all rights we do not expressly give you.
7. Things you may not do
You agree not to:
- copy, sell, share, or publish the App's content, except as the App allows;
- reverse engineer, decompile, or try to get the App's source code;
- interfere with or disrupt the App or its servers, or try to access accounts or data that aren't yours;
- use bots, scrapers, or other automated tools to access the App; or
- use the App for anything illegal or harmful.
8. Updates and availability
We may update the App from time to time, including automatic updates that download in the background. We may add, change, or remove features, or stop offering the App. We try to keep the App available, but we do not promise it will always work without interruption or errors. Content you download for offline use may need to be refreshed or may stop being available.
9. Fees
The App is currently free to use. If we add paid features in the future, we will show you the price and terms before you pay, and purchases will be handled through the Apple App Store or Google Play.
10. Ending your use
You may stop using the App at any time and ask us to delete your account as described in the Privacy Policy. We may suspend or close your account if you break these Terms, if the law requires it, or to protect other members or the App. When your account ends, your right to use the App ends too. Sections 6, 7, and 11 through 17 still apply after that.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE APP WILL REDUCE YOUR STRESS OR IMPROVE YOUR HEALTH, OR THAT IT WILL BE ERROR-FREE OR SECURE. Some places do not allow these disclaimers, so some of them may not apply to you.
12. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, QUÉDATE TRANQUILA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA OR PROFITS, THAT COME FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE APP WILL NOT BE MORE THAN THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100. Some places do not allow these limits, so some of them may not apply to you.
13. Indemnification
If you break these Terms or misuse the App and someone makes a claim against Quédate Tranquila because of it, you agree to cover our reasonable losses and costs from that claim, including reasonable legal fees.
14. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. If you have a concern, please contact us first. Most issues can be resolved informally, and we will try to resolve yours within 30 days. If we cannot, any legal dispute will be handled in the state or federal courts located in [COUNTY, STATE], and both you and we agree to those courts' jurisdiction.
15. App store terms
If you downloaded the App from the Apple App Store or Google Play, these Terms are between you and Quédate Tranquila, not Apple or Google. Quédate Tranquila, not Apple or Google, is responsible for the App, its content, and any support or claims about it. Your use of the App must also follow the rules of the store you got it from. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. If the changes are important, we will tell you in the App or by email before they take effect. If you keep using the App after an update, you accept the updated Terms.
17. General
These Terms and the Privacy Policy are the entire agreement between you and us about the App. If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a right immediately, we can still enforce it later. You may not transfer your rights under these Terms to anyone else. We may transfer ours as part of a merger, acquisition, or sale of assets.
